Please read the following Terms & Conditions and Process Ground Rules. They are the specific terms, conditions and rules applicable to our agreement concerning your participation in the Path of Love process. If you have any questions before agreeing to any of the Terms & Conditions or Ground Rules, please contact the Path of Love organizer that sent you this document. We will always discuss and address any concerns you may have. DO NOT SIGN THESE TERMS AND CONDITIONS UNLESS YOU ARE IN AGREEMENT WITH THEM.

References in these Terms & Conditions to "Path of Love" or to "we", "our" or "us" in each case refers to POL Global Foundation Limited. References to "I", "you" or "your" are to you, the participant on the Path of Love Process (which we also refer to as "the Process" and "the course" and/or "the programme.") Individual and group sessions may be offered and provided before or after the Path of Love process. Any such sessions are covered and governed by these Terms and Conditions to Agreement and Process Ground Rules. These Terms & Conditions are the exclusive basis for the contract between you and us. No other terms or conditions (whenever and however communicated), nor any amendment or addition to these Terms & Conditions, will apply unless agreed by a director of POL Global Foundation Ltd in writing.

Attending the Course

On arrival, before starting the course, we will ask you to complete and sign our Declaration and Consent Agreement. This form requires you to confirm that all information that you submitted to attend the process is up to date and fully accurate. Attendance is strictly conditioned on you completing and signing the form before the start of the course. Please note that if there have been any significant changes to your personal or therapeutic situation affecting your ability to fully participate and benefit from the program, we reserve the right to decide that you cannot attend the course. Please understand that if we don’t receive your pre-process work, including the signed Terms & Conditions, in sufficient time before the course start date, we reserve the right to suspend your place on the course.

Today, it is particularly important to be aware of the impact of Covid 19. Path of Love is making every effort to ensure the safety of its participants and staff. Path of Love is also requiring that each participant and staff member represent their full and complete compliance with all applicable safety measures and requirements. By your execution of these Terms and Conditions you specifically acknowledge and agree to the following language from the Disclaimer section below: “while you are participating in the Process or at the location of the Process, you assume the risk of, and the responsibility for, any injury or illness that you suffer….” Exposure to Covid 19 remains theoretically possible despite the best efforts of all concerned. Hence, in order to participate, you must specifically agree that your liability waiver and assumption of risk includes any exposure to Covid 19 during the process.

Confidentiality - Proprietary/Copyrighted Material

You understand and agree that the Path of Love Process, including the pre and post-Process material, is a private and personal educational/transformational experience for each participant, and that the processes constitute Intellectual Property, are proprietary and copyrighted, and are owned by POL Global Foundation Ltd. As such, you agree to respect the confidentiality of all participants and their remarks and actions, as well as the processes themselves; you agree to keep all such information private and confidential; and, to make no use or dissemination of the Processes without the written permission of POL Global Foundation Ltd. Materials presented are intended solely for Process use. You are not permitted to duplicate, resell, modify and resell, and/or repackage and resell, and/or rename and resell the materials. Materials or any part of them are not to be used in connection with any seminar, training programme, therapy, process, consulting, or other business activity except Path of Love. This agreement supersedes any prior agreements you may have regarding material use. By signing these Terms & Conditions, you agree to be bound beyond copyright law.

You also agree to respect the confidentiality, identity and experience of all Path of Love participants and staff, and not to reveal or disclose same. You accept that photography, video and sound recording are not permitted at the venue during the Process week.

Process Ground Rules

These rules are for your safety and to ensure that you, and the rest of the participants, gain the most from the course.

  • Drugs, alcohol and other mood altering drugs (legal or illegal) are prohibited for the duration of the course. You must notify us before the course commences of the use of prescribed medication (which you should continue to take as instructed by your doctor).

  • For your own safety and the safety of others, it is a requirement of the Path of Love that you do not take alcohol, or any recreational drugs to the Process venue, and that you are not active in any eating disorders at any time during the Process. If you break this agreement, then you will be asked to leave the course.

  • You must refrain from ingesting certain strong substances (hallucinogenics, etc.) for a minimum of one month before participating in Path of Love, due to the potential for short and long-term psychological impact.

  • Outside contact is not permitted, unless with prior arrangement, or with our permission upon a showing of urgent and/or medical need. This includes phone calls, texting, and internet use. You may be asked to hand in your mobile phone(s) and other communication devices upon registration. If so, these will be kept for you in a safe and secure place, and will be returned on the last day of the process. A contact number will be given to you to pass onto friends and family. You will be informed of all calls/messages that we receive.

  • Accommodations are usually shared, and will always be with the same gender.

  • Physical exercise such as yoga, your usual work-out practice, etc., is not encouraged due to time constrictions. Path of Love has specific meditation practices during the programme.

  • Please also refrain from bringing books or magazines and music to the course.

  • You agree to refrain from all sexual activity and sexual contact during the eight days of the Process.

  • You are responsible for your wellbeing; including getting sufficient food and sleep during the Process and taking any prescribed medicines on time. Some of the processes permit vigorous, expressive movement. You are responsible to limit your movement and physical activity to that which you are able to tolerate without physical pain or injury. You understand that your tolerance and capacity is known to you and is not known by the Path of Love Staff, unless you inform them. If at any time you feel unwell or unable to continue for any reason, you are to immediately speak to a member of Path of Love Staff know, and they will give you the support that you need at the time. A record of advice given or treatment suggested will be kept.

  • To benefit from this course, it is essential that you participate in all of its stages.

Warranties

No warranties of any kind or nature are given by POL Global Foundation Limited.

Disclaimer, Release and Indemnity

POL Global Foundation Ltd disclaims all liability for any illness, injury, death, property loss, or damage suffered by you directly or indirectly caused by negligence or breach of contract, breach of duty, or breach of statutory duty by POL Global Foundation Ltd and its members, Process leaders, facilitators, staff members, employees, organizers, and agents (Releasees) which occurs while you are participating in the Process, to the extent permitted by applicable law.

You understand and agree that the Process is an intensive inner exploration and also involves some quite vigorous, expressive processes and movement. You understand and acknowledge that the Process is educational and transformational in nature, is not therapy or healthcare of any sort and is therefore not required to comply with and is not subject to any legal standards or requirements addressing and applicable to therapy or healthcare. You understand that you are solely responsible to physically participate only to the extent to which you are physically able to do so without risk of injury. You acknowledge that when you participate in the Process, you do so at your own risk, and you acknowledge that while you are participating in the Process or at the location of the Process, you assume the risk of, and the responsibility for, any injury or illness that you suffer, death or property damage or loss however such injury, illness, death, loss, or damage may occur, to the extent permitted by applicable law. You understand and acknowledge that we carry no health insurance providing coverage to you.

You understand and confirm that you have represented to us that you are physically, mentally and emotionally able to tolerate and fully participate in the process. You further understand and agree that if you experience an unexpected physical, mental or emotional condition or event during the process, which, in the understanding and experience of the process leaders, and at their sole discretion, makes it inappropriate for you to continue in the process, that you will accept and follow their advice and leave the process without delay.

You release the Releasees from all and any liability or claims arising out of or in connection with any illness, injury, death, property loss, or damage that you may suffer or incur directly or indirectly caused by the negligence, breach of duty, breach of contract, or breach of statutory duty by the Releasees, or in any way whatsoever, while you are participating in the process or present on the premises where the Process is conducted to the extent permitted by applicable law.

You release, and will indemnify and hold harmless the Releasees against all and any actions or claims which may be made by other parties, including but not limited to the program facilities’ owner or operator, arising out of or in connection with any illness, injury, death, property loss, or damage suffered by such other parties as a result of your intentional acts, negligence, breach of duty, breach of contract, breach of statutory duty or otherwise to the extent permitted by applicable law including but not limited to any damage caused or done by you to the property of such other parties.

This release, waiver and indemnity will bind your heirs, executors, personal representatives, and assigns.

You agree to indemnify the Releasees for any liability and cost which we may incur as a result of any breach by you of these Terms & Conditions (including, but not limited to, the clause headed "Confidentiality - Proprietary/Confidential Material") to the extent permitted by applicable law.

Booking Terms: Fees/Charges

Prices quoted by us indicate the cost of accommodation, tuition, meals, all course materials and any relevant taxes according to country such as (VAT, MWST, GST). No refund will be made if you do not fully participate in this, for example if you do not require all meals.

Booking Terms: Cancellation & Refund Policy

  • All cancellations must be submitted in writing to the Path of Love Organizer that you are working with.

  • If you cancel more than 6 weeks before the course begins your payment will be refunded to you. Only an administrative fee of €150 (or equal value in the local currency) will be retained for internal costs, such as administrator time and bank transfer fees. Alternatively, your payment can be transferred to a later date in the same country, at no extra charge. It can also be transferred to a later date in a different country, but you will be responsible for any additional wire transfer fees that are incurred.

  • If you cancel between 2 and 6 weeks before the course start date we will retain 25% of the full course fee. The remaining 75% of the full course fee will be refunded to you. Alternatively, your payment can be transferred to a later date in the same country, at no extra charge. It can also be transferred to a later date in a different country, but you will be responsible for any additional wire transfer fees that are incurred. The exception to this is if the Path of Love Global Foundation decides that the course is not suitable for you. In this case, your full payment will be fully refunded. Only wire transfer fees will be retained.

  • If you cancel within 2 weeks of the course start date, or if you do not attend the first course session, or if you withdraw from the course after the start of the first course session, no part of the fee will be refunded.

  • We do not accept pregnant women for Path of Love. If you become pregnant after being accepted for the course and paying your course fee, your payment can be transferred to a later date in the same country, at no extra charge. Alternatively, your payment can be transferred to a later date in a different country, or we can refund your payment in full. Only wire transfer fees and a pre-workshop interview fee (if applicable) will be retained.

  • If you are asked to leave the Process for breaching these Terms & Conditions, or if you are in breach of our Process Ground Rules, no part of the course fee will be refunded.

  • The Path of Love 7-Day Retreat is an intense inner exploration, the outcome or success of which is entirely dependent on your full participation for the duration of the program. Therefore you accept the rules, conditions and instructions for the extent of the Process, which, for psychological reasons, are an integral part of the course and for your wellbeing. To benefit fully from this course, it is essential that you participate in all of its stages. If you feel you must leave the group during the process, you agree to consult with a facilitator before leaving.

Booking Terms: Policy for Changing Course Date

If you suffer from sudden ill health, or recent bereavement, and need to change the course date, please contact your Path of Love Organizer immediately in writing. Your course fee can be suspended until a suitable alternative date can be found. Refunds, beyond those addressed in the policies set forth above, may be considered if a medical certificate is provided.

Cancellations and Changes to Courses by the Path of Love

POL Global Foundation will make every effort to provide the programme as agreed. However, we reserve the right to alter or cancel the venue or date of a course, for any cause beyond our reasonable control. In the very unlikely event that a course is cancelled, you may transfer your registration to another course or receive a full refund of monies paid to us, less administration fees. Our liability will be limited to that refund. The POL Global Foundation Ltd. will not be liable for any other direct or indirect loss, cost or expense, of any nature, however caused, including travel related expenses. It is recommended to obtain travel insurance and/or refundable or transferable tickets if traveling.

Law and Jurisdiction Applicable

These Terms & Conditions, and all other parts of the contract between you and the POL Global Foundation Limited, are governed by the law of the United Kingdom. Exclusive jurisdiction over any action or claim arising out of or in any way related to the Agreement to participate and participation in the POL shall be in the Courts of the United Kingdom nearest the offices of POL Global Foundation Limited.

All Provisions Negotiable and Accepted

All of the Terms and Conditions stated above are subject to negotiation and discussion. By signing these Term or Condition, the participant waives any and all objections to such Terms and Conditions, and accepts all of the Terms and Conditions as stated.

Severable Terms

If any provision(s) of these Terms and Conditions is found to be unenforceable, all the remaining Terms and Conditions shall remain in full force and effect.

Entire Agreement

This Agreement constitutes the entire agreement and understanding between you and us. This Agreement shall supersede any prior promises, agreements, representations, undertakings or implications whether made orally or in writing between you and us relating to the subject matter of this agreement.

Amendment

This Agreement may not be amended except in a writing, signed by the parties.

By giving my signature below, I agree and confirm:1) that I have read and understand the above Terms & Conditions and understand and accept them as legally binding; 2) that all my answers and other information included in the Application, Medical Information Form and Questionnaire which I am submitting to attend the Process were true and complete when given and remain true, correct and complete at the date my signature is given, and; 3) that I did not omit anything relevant from any response or statement. I agree to notify POL Global Foundation Ltd. immediately if any of my answers change, and verify this signature to be legally binding.

I acknowledge that a legally binding agreement, including all stated terms and conditions, is formed when POL Global Foundation Ltd. accepts my application, following the interview process.

No Signature by POL Global Foundation Ltd. of these Terms and Conditions is Required.

No signature or execution by POL Global Foundation Ltd. of these Terms and Conditions is required for them to be effective and part of our agreement. Following execution of the Terms & Conditions by you, the participant, our agreement to these Terms and Conditions is finalized by your execution thereof, and your being considered for acceptance into the program by POL Global Foundation Limited. Acceptance of these Terms and Conditions is required from all participants, and said Terms and Conditions are accepted by POL Global Foundation Limited without execution of this Terms and Conditions form by POL Global Foundation Ltd.

Following the interview, you will advised of our decision on your application, and be provided with our Medical Information Form, Terms & Conditions and Questionnaire, which must be completed, reviewed, signed and returned to POL Global Foundation Ltd. Finally, a Declaration and Consent Agreement must be completed and signed at the beginning of the Path of Love Process to confirm that all of the information provided remains current and accurate.
